식품위생법 제2조 4항 및 5항
기구
다음 각 목의 어느 하나에 해당하는 것으로서 식품 또는 식품첨가물에 직접 닿는 기계·기구나 그 밖의 물건(농업과 수산업에서 식품을 채취하는 데에 쓰는 기계·기구나 그 밖의 물건 및 「위생용품 관리법」 제2조 제1호에 따른 위생용품은 제외한다)을 말한다.
가. 음식을 먹을 때 사용하거나 담는 것
나. 식품 또는 식품첨가물을 채취·제조·가공·조리·저장·소분[(小分): 완제품을 나누어 유통을 목적으로 재포장하는 것을 말한다. 이하 같다]·운반·진열할 때 사용하는 것
용기·포장
식품 또는 식품첨가물을 넣거나 싸는 것으로서 식품 또는 식품첨가물을 주고받을 때 함께 건네는 물품을 말한다.

식품위생법 제4조 4항 및 5항(우리나라와 동일하게 정의하고 있다.)
기구
음식기와 식품 또는 식품첨가물의 채취 제조 가공 조리 저장 운반 진열 수수 또는 섭취에 사용되는 것으로서 식품 또는 식품첨가물에 직접 접촉되는 기계 기구 기타의 물건을 말한다. 다만, 농업 및 수산업에 있어서 식품의 채취에 사용되는 기계 기구 기타의 물건은 제외된다.
용기·포장
식품 또는 식품첨가물을 넣거나 싸는 물품으로서 식품 또는 식품첨가물을 수수(授受)할때 함께 인도되는 물품을 말한다.

연방식품의약품화장품법(Federal food, Drug, and Cosmetic Act, FFDCA)
식품첨가물이란 의도적으로 식품에 첨가하여 직접 또는 간접적으로 식품성분을 구성하는 물질로 사용되거나, 또는 식품의 특성에 영향을 미치는 모든 물질을 의미한다. 이 같은 정의에는 식품의 생산, 제조, 포장, 가공, 조리, 처리, 운송 또는 보관 등의 과정에서 사용되는 모든 물질이 포함된다. The term 'food additive' means any substance the intended use which results or may reasonably be expected to result, directly or indirectly, in its becoming a component or otherwise affecting the characteristics of any food(including any substance intended for use in producing, manufacturing, packing, processing, preparing, treating, packaging, transporting or holding food; and including any source of radiation intended for any such use).
연방규칙(Code of Federal Regulations, CFR)
식품접촉물질이란 식품의 제조, 포장, 운송 또는 보관에 사용되는 재질 성분으로서 의도적으로 사용되는 모든 물질을 말한다. A Food contact substance is any substance that is intended for use as a component of materials used in manufacturing, packing, packaging, transporting or holing food if such use is not intended to have any technical effect in such food.

Framework Regulation (EC) No 1935/2004
식품접촉물질은 포장재, 칼, 스푼, 포크, 접시, 가공기계류, 용기 등 식품과 접촉하게되는 모든 물질 및 제품뿐만 아니라 사람이 섭취하는 물(단, 수도와 같이 물이 공급되는 장치는 제외)과 접촉하는 모든 물질 및 제품을 말한다. Food contact materials are all materials and articles intended to come into contact with foodstuffs, including packaging materials but also cutlery, dishes, processing machines, containers etc. The term also includes materials and articles which are in contact with water intended for human consumption but it does not cover fixed public or private water supply equipment.
